(Jun 11, 2010) Albania's Parliament adopted a law on April 22, 2010, that initiates a tax for the use of state-owned land for construction (Law No. 10270, On the Right of Privatization of Used State-Owned Land and the Tax Levied on the Right of Use of State-Owned Land). This law came into effect on June 6, 2010, and applies to resident and non-resident individuals and companies. The rate is set at 10% of the value of the land, which is in turn based on a Decision of the Council of Ministers. Those subject to the tax must submit information about any state-owned construction land they are using to the regional tax directorates within a month of the enforcement date of the Law. The only exemptions are for state-owned land used for investment or tourism and for land on which illegally constructed buildings are in the process of legalization. Any existing arrangements for lease payments for such lands continue in force.
