(Nov 02, 2007) On October 16, 2007, in a case involving an appeal by a Spanish manager who had filed a suit against his employer for forcing him to retire at the age of 65, the European Court of Justice held that the governments of the Member States of the European Union have the discretion to establish mandatory retirement age limits if they so desire. The Court stated that although age discrimination is illegal in all EU Member States, the general principle of equal treatment in employment does not prohibit measures "objectively and reasonably justified in the context of national law by a legitimate aim relating to employment policy and the labor market."
