Italy: New Law Reorganizes Ministries

(Sept. 27, 2018) On July 13, 2018, new legislation reorganizing certain government ministries entered into force in Italy. Restructuring the Ministry of Agricultural, Food and Forestry Policies and Tourism

Effective January 1, 2019, the new legislation changes the name of the Ministry of Agricultural, Food and Forestry Policies to Ministry of Agricultural, Food and Forestry Policies and Tourism. (D.L. No. 86, art. 1.5.) Accordingly, tourism functions currently exercised by the Ministry of Cultural Heritage and Activities and Tourism are to be transferred to the Ministry of Agricultural, Food and Forestry Policies and Tourism. (Id. art. 1.1.) The Law eliminates the Directorate General for Tourism at the Ministry of Cultural Heritage and Activities and Tourism, transferring its functions to the Tourism Department created at the Ministry of Agricultural, Food and Forestry Policies and Tourism. (Id. art. 1.2.) The Ministry of Cultural Heritage and Activities retains the administration of the “School of Cultural Heritage and Activities and Tourism,” which is renamed as the “School of Cultural Heritage and Activities.” (Id. art. 1.6.) Under the new Law, a decree of the President of the Council of Ministers will adapt the internal organization and structure of the new Ministry of Agricultural, Food and Forestry Policies and Tourism. Restructuring the Ministry of the Environment and Protection of the Territory and the Sea

The functions currently exercised by the President of the Council of Ministers concerning the coordination and monitoring of environmental emergency measures are transferred to the Ministry of the Environment and Protection of the Territory and the Sea. (Id. art. 2.1.) Such functions also include those aimed at fighting hydrogeological instability and promoting soil protection. (Id. art. 2.3.)

New Functions of the President of the Council of Ministers vis-à-vis the Current Demographic Crisis

Under the new Law, the President of the Council of Ministers receives new functions concerning matters related to family, adoption, infancy and adolescence, and disabilities. (Id. art. 3.1.) These new functions refer to intergenerational and relational problems, promotion and protection of family well-being, support of maternity and paternity, administration of work and family time, measures to support the family, parenting and birth, and other measures aimed at addressing the current demographic crisis affecting Italy. (Id. art. 3.1(a).) The functions of the President of the Council of Ministers Functions will also include the administration of the “Social Security Fund for Persons Who Perform Unpaid Care Work Deriving from Family Responsibilities.” (Id. art. 3.1(a)(2).) The new functions seek to include disabled persons in academic activities and promote their accessibility and mobility with the purpose of achieving their full social participation and integration. (Id. art. 3.1(d).)

Government Functions Related to the ‘Casa Italia’ Project

The purpose of the “Casa Italia (Italy House) Project is to develop, optimize, and integrate instruments for the care and improvement of Italian territory, urban areas, and the residential patrimony, including buildings’ use of energy, structural safety, and efficiency. The new legislation grants new functions to the Ministry of Education, Universities and Research concerning the Casa Italia Project. (D.L. No. 86, art. 4.3.)

In addition, the Law reorders the competences of the Agency for Territorial Concessions and the Interministerial Committee for Policies on Space and Aerospace Research.  (Id. arts. 4-ter(1) & 4-quater, respectively.)
