European Union: Introduction of Settlement Procedure for Cartels

(Nov. 2, 2007) The European Commission has recently proposed two legislative measures that call for settlement of cartel cases in which the parties involved admit their involvement in the cartel and liability but also agree to follow an expedited and simplified procedure. The two measures consist of a Regulation and a Commission Notice. Under the proposal, the European Commission would impose lesser fines on parties who agree to settle a cartel case in this manner. The Commission has called for a public consultation from interested parties.
